Non-judicial remedy mechanisms in Peru and Colombia National Human Rights Institute and OECD National Contact Point

During 2021 and 2022 the Danish Institute for Human Rights has implemented the project "Strengthening non-judicial state mechanisms for access to remedy in business and human rights (INDH and OECD NCP) in Colombia and Peru" with the support of the Responsible Business Conduct in Latin America and the Caribbean Project (RBCLAC).
This one-year project aims at reinforcing the National Human Rights Institutions (NHRIs) and the OECD National Contact Points (NCPs) in Colombia and Peru in their role of facilitating access to remedy in business-related human rights abuses.
To achieve this, the project has facilitated sessions between representatives of NHRIs and NCPs in both countries to promote an exchange of experiences in non-judicial reparation mechanisms around issues related to business and human rights, such as: workers’ rights, gender perspective, indigenous people’s rights, environment and human rights, and reparations. All this within the regulatory and public policy framework at the national, regional, and global level.
This workshop will be hosted for civil society organisations and social organisations in Colombia. It seeks to provide answers to questions around the work of NCPs and NHRIs as non-judicial remedy mechanisms in business and human rights.
Thus, participants can acquire more knowledge about the regulatory instruments on business and human rights, such as the OECD Guidelines, Guiding Principles on Business and Human Rights, among others. This will ultimately equip them with more information about the principles and conceptual frameworks that regulate business activities within the framework of human rights.
TALLER: Mecanismos estatales no judiciales de acceso a reclamación en materia de empresas y derechos humanos Defensoría del Pueblo y Punto Nacional de Contacto de la OCDE
En 2021 y 2022, con el apoyo del proyecto Conducta Empresarial Responsable en América Latina y el Caribe (CERALC), el Instituto Danés de Derechos Humanos ha implementado el proyecto “Fortalecimiento de mecanismos estatales no judiciales de acceso a reparación en materia de empresas y derechos humanos (INDH y PNC-OCDE) en Colombia y Perú”, con el objetivo de fortalecer, a través del intercambio de experiencias, a las INDH y los PNC de Colombia y Perú, en su dimensión como mecanismo de reclamación no judicial en asuntos de empresas y derechos humanos.
Con este propósito, el Proyecto ha generado espacios de intercambio y discusión a nivel bilateral y grupal con colaboradores de ambas instituciones, alrededor de temáticas en materia de empresas y derechos humanos, tales como: derechos laborales, dimensiones de género, derechos de los pueblos indígenas, medio ambiente y derechos humanos, y reparaciones en general. Todo ello en el marco normativo y de política pública a nivel nacional, regional y global.
El objetivo de esta actividad de difusión con organizaciones de sociedad civil y organizaciones sociales de Colombia es que estas puedan adquirir mayor conocimiento y absolver dudas que tengan sobre la labor que cumplen los PNC y las INDH en su rol de mecanismos de reclamación no judicial en asuntos de empresas y derechos humanos.
Así, las organizaciones participantes pueden adquirir más conocimiento sobre los instrumentos normativos sobre empresas y derechos humanos, como las Líneas Directrices de la OCDE, Principios Rectores sobre Empresas y Derechos Humanos, entre otros. Ello en última instancia contribuirá a que tengan más información sobre los principios y marcos conceptuales que regulan las actividades empresariales en el marco de los derechos humanos.
