State cooperation preventing access to asylum: the law and politics of cooperative non-entrée

This project investigates the deterrence policies of European states and Australia in the area of access to asylum.

This project investigates the deterrence policies of European states and Australia in the area of access to asylum, mapping bilateral cooperation and analysing the legality of such policies under international human rights and refugee law.

Purpose

Access to asylum is increasingly under pressure, as western states cooperate with origin and transit states to prevent asylum seekers reaching their territory. This project investigates the policies of European states and Australia in this field, mapping bilateral cooperation on migration control and protection elsewhere policies.

These policies significantly challenge the existing refugee and human rights regime, still largely tied to territory and single state responsibility. This project therefore considers the scope of extraterritorial obligations and shared responsibility under international law in the context of policies preventing access to asylum.
