The right to parenthood
The study seeks to assess whether Danish law and practice should be adjusted in order to ensure effective Danish compliance with human rights obligations which follow from the CRPD, particularly Article 23.
The study examines and analyzes relevant human rights provisions and obligations in the Danish legislation in relation to support for parents with disabilities. Through eight different cases concerning the placement or forced removal of children whose parents have disabilities, we highlight some of the problems that can arise when the proper support is not given.
The report concludes with a number of recommendations on what changes should be implemented in relation to the Danish regulations and practices in the field so as to ensure better Danish compliance with Denmark’s human rights obligations.
